1. Agreement to Terms

By accessing or using AT Valid's services, website, or API (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use our Services.

These Terms apply to all users, including visitors, registered users, and API consumers. By using our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

To access certain features of our Services, you must register for an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us of any unauthorized use of your account
• Not create an account using false or misleading information
• Not create multiple accounts for abusive or fraudulent purposes

You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

4. Credits and Payments

4.1 Credit System

AT Valid operates on a prepaid credit system. Each validation operation consumes credits from your account balance. The number of credits required per operation varies by service type and is clearly displayed in your dashboard and our pricing page.

4.2 Credits Never Expire

Your purchased credits never expire. Unlike many competitors, AT Valid does not impose expiration dates on your credit balance. You may use your credits at any time as long as your account remains in good standing.

4.3 Pricing

Our current pricing is available on our website at atvalid.com/pricing. Prices are subject to change with notice. Any price changes will not affect credits already purchased.

4.4 Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed at checkout. All payments are processed securely through our payment partners. You agree to provide accurate payment information and authorize us to charge your selected payment method.

4.5 Refund Policy

Credit purchases are generally non-refundable. However, we may consider refund requests on a case-by-case basis under the following circumstances:

• Technical issues on our end that prevented service delivery
• Duplicate charges due to system errors
• Request made within 14 days of purchase with minimal credit usage

5. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

5.1 Prohibited Activities

• Spam or Unsolicited Communications: Use our Services to validate email addresses for the purpose of sending spam, unsolicited bulk email, or any communication that violates CAN-SPAM, GDPR, or other applicable laws
• Illegal Use: Use our Services for any illegal purpose, including but not limited to fraud, harassment, stalking, or violation of privacy laws
• Data Harvesting: Use our Services to harvest, collect, or scrape personal information without proper consent
• Malicious Activities: Attempt to probe, scan, or test the vulnerability of our systems or breach security measures
• Reverse Engineering: Reverse engineer, decompile, or disassemble any portion of our Services or attempt to derive source code
• Reselling: Resell, sublicense, or provide access to our Services to third parties without explicit written authorization
• Abuse: Engage in any activity that disrupts, damages, or impairs our Services or infrastructure

5.2 Rate Limits

To ensure fair usage and system stability, API requests are subject to rate limits. Default rate limits are:

• Real-time API: 10 requests per second per account
• Bulk uploads: 1 million records per file
• Concurrent connections: 5 per account

6. API Usage

6.1 API Keys

API access requires authentication using API keys. You are responsible for keeping your API keys secure and confidential. Treat your API keys like passwords - do not share them publicly or commit them to version control systems.

6.2 Fair Use

Our API is designed for legitimate data validation purposes. Fair use includes:

• Validating data for your own business operations
• Integrating validation into your applications for end-user benefit
• Building internal tools that improve data quality

6.3 Rate Limiting

We implement rate limiting to ensure service availability for all users. If you exceed rate limits, your requests may be temporarily throttled or rejected. Implement proper error handling and exponential backoff in your integrations.

6.4 Caching

You may cache validation results for up to 30 days. After this period, you should re-validate addresses to ensure accuracy, as email validity can change over time.

6.5 API Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted API availability. We may perform maintenance that temporarily affects service. We will provide advance notice of planned maintenance when possible.

7. Intellectual Property

7.1 Our Intellectual Property

The Services, including all content, features, functionality, software, and technology, are owned by AT Valid and are protected by copyright, trademark, and other intellectual property laws. The AT Valid name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AT Valid.

7.2 Your Data

You retain all rights to the data you submit for validation. By using our Services, you grant us a limited license to process your data solely for the purpose of providing the Services. We do not sell, share, or use your data for purposes other than service delivery.

7.3 Feedback

If you provide feedback, suggestions, or ideas about our Services, you grant us the right to use such feedback without restriction or compensation to you.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AT VALID DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES OF NON-INFRINGEMENT
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF VALIDATION RESULTS
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE

While we strive for high accuracy in our validation services, we cannot guarantee 100% accuracy. Email validity is dynamic and can change after validation. You should use validation results as one factor in your decision-making process.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AT VALID, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF OUR SERVICES
• DAMAGES RESULTING FROM INTERRUPTION OR CESSATION OF SERVICES
• DAMAGES RESULTING FROM RELIANCE ON VALIDATION RESULTS

IN ANY CASE, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless AT Valid and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights, including privacy or intellectual property rights
• Any data you submit to the Services
• Your violation of applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting [email protected] or using the account deletion feature in your dashboard. Upon termination, your access to the Services will cease immediately.

11.2 Termination by Us

We may suspend or terminate your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe:

• Violates these Terms or our Acceptable Use Policy
• Is harmful to other users, third parties, or our business interests
• Is fraudulent or illegal

11.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Any unused credits in your account at the time of termination for cause will be forfeited. If we terminate your account without cause, we may, at our discretion, provide a pro-rata refund of unused credits.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Services shall be submitted to the exclusive jurisdiction of the courts located in Sao Paulo, Brazil.

If you are a consumer residing in the European Union, you may also have the right to resolve disputes through the European Online Dispute Resolution platform or your local consumer protection agency.
